Vagabonde Adventures understands that your privacy is important to you. When you book a sailing charter or instructional course (“Charter”) with us, you trust us with your personal information. We respect and value the privacy of everyone who visits our site and will only collect and use information in a way that is useful to you and in a manner consistent with your rights and our obligations under the law. 

This Privacy Policy describes the personal data we collect, how it is used and shared, and your choices and rights regarding this data. Please read this Privacy Policy carefully and ensure that you understand it. If you use our site, it is assumed that you have accepted our Privacy Policy. If you do not accept our Privacy Policy, you must stop using our site immediately. 

  1. Scope

For purposes of this Privacy Policy, references to “we,” “our,” and “us” mean Vagabonde Adventures LLC and its affiliates. Our “site” means www.vagabondeadventures.com. Our site is owned and operated by us. 

This Privacy Policy applies to all users of the services provided by Vagabonde Adventures located anywhere in the world, including users of our site and those who reserve a Charter with us. This Privacy Policy does not extend to any website that is linked to our site, whether we provide those links or if they are shared by other others. We provide these references and links for your convenience only. We do not endorse any of the linked sites, their content, or their information practices. We have no control over how your data is collected, stored, or used by other websites, and we advise you to check the privacy policies of any such websites before providing any data to them. You are solely responsible for any interactions you may have with such sites. If you have been referred to us from another site or by any other third party, the information that you provide to them will also be governed by their privacy policy, which we recommend you read. 

Our privacy practices are subject to applicable laws in the places where you reserve a Charter. This means that we engage in the practices described in this Privacy Policy in a particular country or region only if permitted under the laws of those places. 

  1. What Data Do We Collect?

Some data will be collected automatically by our site (see Section 10 below on Cookies), while other data will be collected if you voluntarily submit it, such as when you sign up for electronic updates, alerts, and other information over email, reserve a Charter, communicate or otherwise interact with us through social media, or provide the information to one of our Customer Service Representatives or over email. We will indicate at information collection points whether the requested information is required or optional, as well as inform you what the consequences will be if you do not provide the required or optional information, such as the inability to access important functions or our site. When you submit personally identifiable information to us, whether such information is required or an option, that information will be subject to this Privacy Policy. 

We automatically collect the following data: IP Address; Web Browser Type and Version; Operating System; Your Activity on Our Site; Sites You Are Referred from; and Sites You Exit To. We may collect any of the following data: Name; Date of Birth; Postal Address; Country of Residence; Phone Number; Email Address; Gender; Business/Company Name; Job Title; Profession; Visa Details; Dietary Requirements; Nationality; Marital Status; Country of Birth; or Financial Information (Credit or Debit Card Numbers).

Unless otherwise clearly provided, our policy is not to ask for any sensitive personal data from you about, for example, your ethnic or racial origin, religious beliefs, physical or mental health, political opinions, or sexual orientation. However, we or our service providers may require certain sensitive personal data to provide services that you have requested or respond to your inquiries, such as ensuring a disability is accommodated or preparing a menu according to your needs. If you choose to provide this sensitive personal data to us for any reason, this will mean that you have given and we have accepted your explicit consent for us, or our service providers, to use that information for the reasons described in this Privacy Policy or as explained at the time you provided the information to us. 

If you provide information to us about any person other than yourself, such as additional travelers you are reserving a Charter on behalf of, you are responsible for ensuring that they understand how their information will be used and that they have given their permission for you to disclose it to us and for you to allow us and our service providers to use it.

  1. How Do We Use Your Data?

Your personal data will only be used and disclosed according to this Privacy Policy or as specifically disclosed to you when you provide the information. We use your personal data to provide the best possible products and services. We also use such data to enhance the security and safety of our users and services, for customer support and responding to your inquiries, for monitoring our responses and processes, for research and development, to send marketing and non-marketing communications to users, to process payments, or to create itineraries. 

We may use your personal information to personalize and tailor your experience, as well as make recommendations and special offers to you about products and services we think may be of interest to you based on your previous inquiries, communications, requests, Charters, browsing activity, or other publicly available information. With your permission and/or permitted by law, we may contact you by email or telephone, or post with information, news, and offers on our products and services. We will not, however, send you any unsolicited marketing or spam.

We do not sell or share identifiable user personal information with third parties for their direct marketing, except with users’ consent. We reserve the right to sell, lease, transfer, or otherwise share without restriction, aggregated, anonymized, and other non-personally identifiable information regarding site usage, sales patterns, traffic patterns, and other statistics about our site and services. 

We reserve the right to use or disclose personal information which we process about you and other people to whom you provide information, as necessary to comply with applicable laws, regulations, legal processes, and law enforcement inquiries, as required by litigation, to take precautions against liability, and protect the security and integrity of the site and the safety of our customers and site users. 

  1. How and Where Do We Store Your Data?

 Data security is very important to us. To protect your data, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure data collected from our site. We only keep data for as long as we need to use it as described in the section above. 

If you are accessing our site from a location in the European Union, some or all of your data may be stored or transferred outside of the European Economic Area (“the EEA”).  You are deemed to accept and agree to this by using our site and submitting information to us. If we do store or transfer data out of the EEA, we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the EEA under the General Data Protection Regulations (“GDPR”). Such steps may include but are not limited to, the use of legally binding contractual terms between us and any third parties we engage and any use of the EU-approved Model Contractual Agreements. 

Notwithstanding the security measures we take, it is important to remember that the transmission of data through the internet may not be completely secure. Therefore, we cannot guarantee the security or accuracy of the information we gather. You are advised to take suitable precautions when transmitting data to us through the internet or otherwise electronically. 

  1. How Do We Share Your Data?

We may share your personal data with our holding company, subsidiaries, or affiliates, including Sailing La Vagabonde. We may sometimes contract with third parties to supply products and services to you on our behalf, such as payment processing, delivery of goods, search engine facilities, advertising, and marketing. In some cases, third parties may require access to some or all of your personal data. If any of your data is required for such purpose, we will take all reasonable steps to ensure that your data will be handled safely and in accordance with your rights, our obligations, and the obligations of the third party under the law. 

We may also compile statistics about the use of our site including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymized and will not include any personally identifying information. We may, from time to time, share such data with third parties such as prospective investors, affiliates, partners, and advertisers. Data will only be shared in compliance with the law. 

Furthermore, there may be certain situations when we are legally required to share certain data we are holding, which may include your personal information, such as if we are involved in legal proceedings or have to comply with the requirements of legislation, court orders, or government authority. We do not require any further consent from you to share your data in such circumstances and will comply as required with any legally binding request that is made of us. 

  1. How Can You Control Your Data?

We want to give you strong control over our use of your data. When you submit information to our site, such as when you request information or book a Charter, you may be given options to restrict our use of your data. For example, you may be able to determine the extent to which we contact you with direct marketing by exercising your option to opt out of receiving emails from us by unsubscribing using the links in our emails or at the point of providing your details. 

  1. Your Right to Withhold Information

You may be able to access certain areas of our site without providing any personal data at all to us. However, to use all features and functions available on our site, you may be required to submit or allow for the collection of certain data. 

  1. Your Right to Delete Information

We aim to ensure that any personal data we collect is accurate, current, and complete. You have the right to access your personal information to correct errors or delete information that you have provided. If you wish to correct or delete your personal data, please contact us at info@vagabondeadventures.com. To respond to your request, we may require follow-up or contact information for the purpose of verifying you are authorized to view the information you are requesting. We have the right to use our discretion and refuse to allow you access to certain information if providing you access to the information may jeopardize another person’s privacy, violate any applicable federal, state, or foreign law, regulation, or directive, or unreasonably burden this site. 

  1. What Happens to Your Data If Our Business Changes Hands?

We may, from time to time, expand or reduce our business, which may involve the sale and/or transfer of control of all or part of our business. Where it is relevant to any part of our business so transferred, data provided by users will be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use the data for the purposes for which it was originally collected by us. You will not be contacted in advance or informed of any changes in the event your data is to be transferred in such a manner. If you are contacted, you will not be given the choice to have your data deleted or withheld from the new owner or controller.

We may place and use cookies and other identification technologies on our site, emails, or online ads. Cookies are small text files that are stored on browsers or devices by websites, applications, online media, and advertisements. We may use cookies and other technologies to facilitate and improve your experience on our site, products, and services. These cookies may be placed by us, as well as third parties whose services we use for statistical and marketing analysis. Cookies and other technologies may be used for purposes such as determining the popularity of the content, determining, and measuring the effectiveness of advertising campaigns, and analyzing site traffic and trends to generally understand the online behaviors and interests of people who interact with our services. Most web browsers have an option that allows you to turn off all cookies or have your computer inform you each time that a request to place a cookie is being made. If you turn cookies off, you may not have access to some features on our site and some of our services. 

  1. Google Analytics

We use Google Analytics to advertise online. Third parties, such as Google, may show you ads on sites across the Internet. These parties use cookies to report ad impressions describing how you interact with these ads. We use the data from Google’s data and analytics to optimize how we show ads across the internet. Please access the settings of your web browser to opt out of receiving Google Analytics cookies or customize Google’s ads. 

  1. Newsletters and Promotional Emails

If you choose to subscribe to Vagabond Adventures’ newsletter, you will receive newsletters and promotional emails about our products, special offers, and other information in the email you provided to us. You can subscribe to our newsletter and promotional emails by making an inquiry, reserving a Charter, or providing your email address directly through the Vagabonde Adventures site. 

If you wish to no longer subscribe to our newsletters or promotional emails, you may opt-out by clicking on the clearly marked ‘Unsubscribe’ button at the bottom of any email from us. You can also contact us at info@vagabondeadventures.com and state your desire to unsubscribe and the email address you would like us to remove from our mailing lists. 

  1. Use of Site By Children

This site is not directed to and does not intend to collect personal data from children under the age of 13. If we are informed that we have collected information from someone in this age category, we will take reasonable steps to delete that information. If a parent or guardian becomes aware that their child has provided us with information without their consent, please contact us at info@vagabondeadeventures.com so we can delete such information. 

  1. California Consumer Privacy Act (“CCPA”)

This section applies to you if you use our site while in California. California residents have certain rights under the CCPA regarding the personal data we collect. However, the CCPA does not cover personal data collected from employees or job applicants, owners, officers, contractors, or other agents in the course of our receipt of business-related services. 

The CCPA allows you to request and obtain from us a list of the third parties to whom we have disclosed your personal data (if any) for direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. These requests may be made two times within 12 months. Requests may be made to info@vagabondeadventures.com. We do not share your personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent. 

The CCPA allows you as a California resident, upon a verifiable request, to request that a business that collects your personal data give you access, in a portable and readily usable form, to the specific pieces and categories of personal data that the business has collected about them, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared. Please refer to this Privacy Policy for information about how we collect, use, and disclose personal data for business purposes. This information will be provided to you free of charge. 

California residents also have the right to submit a request for the deletion of the information under certain circumstances by contacting us at info@vagabondeadventures.com.  Consistent with California law, if you choose to exercise your rights, you will not be discriminated against although some of the functionality or features might change or no longer be available. We will not charge you different prices for a Charter or provide a different quality of services unless those differences are related to your information. Please note that you must verify your identity and request before further action is taken. Government identification may be required.

Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, or the agent must provide other proof that you gave the agent signed permission to submit the request and either: (i) verify your identity with us or (ii) directly confirm with us that you provided the authorized agent permission to submit the request. 

We do not and will not sell personal data to third parties. 

  1. Outside of the United States

Under the General Data Protection Regulation (“GDPR”), we are required to disclose: (a) the controller(s) of your personal information and their contact information; (b) legal bases; (c) your legal rights; and (d) safeguards we rely on for transferring your personal information outside of the European Economic Area (“EEA”). This section applies to you if you use our site while in the EEA or the United Kingdom.

We only process your personal data to the extent that at least one of the following applies: (i) you have consented to the processing of your personal data for a specific purpose (e.g., to send you electronic direct marketing communications based on our consent); (ii) the processing is necessary for us to perform our contract or obligations to you (e.g., to provide you with a Charter) or for use to take actions at your request before we enter into a contract with you; (iii) where we need to process your personal data to comply with a legal obligation we are subject to; (iv) where we need to process your personal information to protect your vital interests (or somebody else’s), including where you are physically or legally incapable of giving consent, for example in the case of an emergency; (v) the processing is necessary for us to establish, exercise, or defend a legal claim; or (vi) the processing is necessary for our or a third party’s legitimate interests. 

Legitimate interests include, but are not limited to, the following: (i) improving our products or services; (ii) understanding how customers travel with us; (iii) marketing and promotional activities; (iv) identifying and pursuing new ways to develop or grow our business; or (v) ensuring the security of our travelers, employees, captains, chefs, and other agents.

You have the right to ask us to (i) provide you with access to the personal data that we hold about you; (ii) correct your personal data; (iii) erase your personal data; (iv) restrict our processing of your personal data; (v) object to our processing of your personal data; (vi) request that we move your personal data to another organization; or (vii) object specifically to us using your personal data for profiling for direct marketing purposes. Where you have specifically consented to our use of your personal data, you have the right to withdraw that consent at any time. Please contact us if you wish to withdraw your consent.

We may transfer your personal data outside of the EEA or the UK, including to the United States. Sometimes, transferring your data outside of the EEA or the UK will be necessary for us to perform our obligations to you (e.g., provide you with a Charter). We use the European Commission’s standard data protection clauses (also known as Model Clauses) to provide safeguards for your personal data transferred outside the EEA or the UK. We want to ensure you that we are seeking to adhere to the strict European and UK standards of data security and usage.
